Explanation and definition of VLOS and BVLOS

Visual line of sight operation (VLOS)
In this UAS operation type, the remote pilot is able to maintain uninterrupted and unaided visual contact with the unmanned aircraft. This allows control of its flight path to avoid collisions with other aircraft, people and obstacles.
The term "uninterrupted" is important here: if the pilot looks at the drone control display and breaks direct sight, they are already in BVLOS. This happens quickly — for example during optical or thermal inspection of photovoltaic systems.
Beyond visual line of sight operation (BVLOS)
This UAS operation type is not conducted in VLOS. If a flight that belongs in the specific category (BVLOS) is conducted in the open category (VLOS), the drone's liability insurance becomes void.
Furthermore, this conduct is considered dangerous interference with air traffic (§ 315 German Criminal Code) and is punishable by imprisonment from 6 months to 10 years. Violations of aviation law may result in fines of up to EUR 50,000.
Liability in companies
Not only the responsible pilot is held liable, but under aviation law also the supervisor who ordered the flight — for example department head, flight operations manager or training lead. The managing director is also liable for failing supervisory and duty-of-care obligations.
Many companies are unaware of the financial and liability risk involved.
